Even though it’s second nature to want to help a friend or loved one who may need a place to stay, the reality is that once the guest has stayed in the rental property for more than 14 days or twice in a 6 month period, they can officially be viewed as a tenant.
Why Should Guests Only Be Allowed To Stay For 14 Days?
Guests should only be allowed to stay for a minimum of 14 days, or they should be added to the lease, because of the simple fact that they present a liability to the owner of the rental property.
Besides being a liability, the long-term guest can ‘stake a claim’ to the property and the landlord will have to evict them to remove them from the property.
Warning Signs That A Guest Is Turning Into A Tenant
Landlords who are wondering if their tenant's long term guests are turning into tenants can confirm their suspicions by asking the following questions:
· Does the long-term guest spend every night at the rental property?
· Are they getting mail delivered to that address?
· Have they moved in their furniture or pets?
· Are they making maintenance requests?
If the answer is yes to any of these questions, the reality is that the long-term guest has essentially become a tenant and the landlord must take steps to encourage the tenant to have themselves added to the lease or ask the guest to leave.
