Since the onset of COVD-19 in March 2020, both renters and landlords nationwide have had to live with the reality of an eviction moratorium.


The original eviction moratorium started on March 27,2020 as part of the Cares Act, back when US officials thought that the pandemic would not last more than a few weeks…


After the Cares Act eviction moratorium expired on July 24th, 2020, the Federal Government implemented the Centers for Disease Control (CDC) eviction moratorium in September of 2020 and that eviction moratorium only recently expired on July 31st, 2021.

The Centers for Disease Control eviction moratorium has helped stop tenants from being evicted from residential rental properties in California, Arizona, and Nevada.


To be eligible for the CDC eviction moratorium, renters have to meet the following criteria:


·        You have used your “best efforts” to obtain government rental assistance


·        You do not expect to earn more than $99,000 in 2021 (or $198,000 if you are married and filed a joint tax return), or you did not need to report income to the federal government in 2020, or you received an Economic Impact Payment (stimulus check) this year


·        You have been experiencing a “substantial” loss of household income because of a layoff or reduced work hours, or you have “extraordinary” out-of-pocket medical expenses (defined as an unreimbursed medical expense that exceeds 7.5% of your adjusted gross income for the year)


·        You have been making your best effort to make partial rent payments as close to the full amount due as possible; and – Being evicted would cause you to become homeless or you would have to move in with a friend or family member (live “doubled up”).

Even though most tenants have relied on the CDC Eviction Moratorium over the last 12+ months to avoid eviction, other states have stepped in with their eviction moratoriums to protect their tenants.


California – The Golden States eviction moratorium has been in place since April 2020 and has been extended each time it comes up for expiration. As of today, California’s eviction moratorium is set to expire on by the end of September 2021, and Governor Newsom has promised that the State of California is going to pay 100% of the back rent that’s due to landlords.


Nevada – As of this writing, Nevada’s eviction moratorium expired in June 2021, but thanks to the American Rescue Plan, tenants who are facing eviction can apply for rental assistance and if their application is approved, the judge will issue a stay on the eviction, and the landlord will be paid.


Arizona – As with California and Nevada, Arizona also had its 120-day eviction moratorium which was implemented at the height of the pandemic. This ban on evictions was extended until the end of February 2021, and since then Arizona residents who have faced eviction have relied on the recently expired CDC eviction moratorium.


Will There Be Another Eviction Moratorium Extension?


Before its expiration, some of our elected officials in Washington have been working overtime to get another extension of the CDC Eviction Moratorium approved but that’s looking increasingly unlikely by the hour.
